Welcome to AVA Exec (“Company”, “we”, “our”, “us”)! By using our service, you agree to comply with and be bound by the following terms and conditions (“Terms of Service”, “Terms”). Please review these terms carefully. If you do not agree to these terms, you should not use our service.

2. Services Provided

AVA Exec provides AI-powered virtual assistant services (“Services”). These services include, but are not limited to, administrative support, schedule management, automated appointment booking and follow up, and other related tasks as defined by the client’s needs.

3. Eligibility

By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract.

4. Account Registration

To access and use our Services, you are required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information up-to-date.

5. Fees and Payment

Pricing

The services are provided at a fixed rate of £995 per month. There is an additional setup fee of £1,179.

Payment

Payments are processed via Stripe. By agreeing to these Terms, you authorize us to charge your payment method for the agreed-upon fees.

Refund Policy

10 Qualified Leads & Conversion Support Guarantee

AVA Exec is confident in our ability to generate high-quality leads and help you convert them into paying patients. We offer a 30-Day Lead & Conversion Support Guarantee.

Qualified Lead Definition

A qualified lead is defined as a patient who

Expresses interest in scheduling an appointment.

Provides valid contact information (name, phone number, email).

Meets your practice's specific criteria for potential patients (Includes details about ideal patient demographics or insurance coverage etc).

Guarantee Details

We guarantee to generate at least 10 qualified leads within 30 days of your avaexec.com subscription start date. We provide ongoing support to help you convert these leads into paying patients. This includes resources, best practices, and access to our customer success team.

Eligibility for Refund

If you do not receive 10 qualified leads within 30 days, you will be eligible for a full refund of your monthly subscription fee, upon fulfilment of the following conditions:

Full Cooperation

You have provided avaexec.com with all necessary information and access to relevant tools and data to optimise lead generation for your practice.

Onboarding Process

You have actively participated in the AVA Exec onboarding process, which includes setup, bot training specific to your services, and automation implementation tailored to your needs.

Campaign Compliance

You have adhered to all agreed-upon campaign parameters and marketing strategies outlined during onboarding.

Please note

This guarantee does not apply to the setup fee. The setup fee covers the initial work required to configure

AVA Exec for your practice.

Additional Considerations

Timeframe

The 30-day guarantee period begins on the start date of your AVA Exec subscription.

Verification Process

AVA Exec will track and report qualified leads based on pre-defined criteria. You will receive regular reports detailing lead generation activity.

Dispute Resolution

In case of a dispute regarding lead qualification, AVA Exec will work collaboratively with you to reach a fair resolution.

6. User Responsibilities

Confidentiality

You agree to maintain the confidentiality of your account information and be responsible for all activities that occur under your account.

Compliance

You agree to use our Services in compliance with all applicable laws and regulations.

Prohibited Activities

You agree not to engage in activities that violate our policies, including but not limited to unauthorized use, distributing harmful content, and infringing on the intellectual property rights of others.

7. Intellectual Property

Ownership

All content, trademarks, and intellectual property rights associated with AVA Exec are the exclusive property of the Company.

Usage

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal or business purposes. You agree not to reproduce, distribute, or create derivative works from our content without explicit written consent.

8. Termination

Termination by Us

We reserve the right to suspend or terminate your account and access to the Services at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Services, us, or third parties.

Payment Failure

If your subscription payment fails, you will be notified and given a 24-hour grace period to resolve the issue. If payment is not received within this period, your account will be paused. Continued non-payment may result in account termination.

Termination by You

You may cancel your subscription at any time by contacting us directly. Cancellation will not entitle you to a refund of any fees already paid unless stated in our refund policy.

9. Limitation of Liability

To the fullest extent permitted by law, AVA Exec shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Services.

10. Indemnification

You agree to indemnify and hold harmless AVA Exec and its affiliates, directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of changes via our website. Continued use of our Services following the posting of any changes to these Terms constitutes acceptance of those changes.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom and the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the United Kingdom and the United States.
